Acceptance of Terms of Use

Please read these Terms of Use and the other Agreements described immediately below before registering for, accessing, or using any portion of the Wentworth Institute of Technology or Wentworth.pro website (the “Site,” which consists of all content and pages located within and accessible at pro.wit.edu web domains) or any other websites, applications, programs or online or mobile products or services of Wentworth Institute of Technology (collectively, the “Services”). The term “Services” includes the Site and all content and pages located within and accessible via the Site, as well as any program material, program or cohort pages and platforms, directories, and other electronic services available via the Site or any of the other Services. These Terms of Use, our Privacy Policy, Academic Catalog, and Student handbook are agreements (the Agreements) between you and Wentworth Institute of Technology. By registering for, accessing, or using any Services, you accept and agree to be legally bound by the Agreements, whether or not you are a registered user or have an account. If you do not understand or do not wish to be bound by the terms of the Agreements, do not register for, access or use any Services.

As used in these Terms of Use, “we,” “us” and “our” refer to Wentworth Institute of Technology.

Modifications

We may make changes to the Agreements at any time but will alert you that we are doing so by giving notice via the Services or by some other means. By registering for, accessing, or using any Services after any changes have been made, you signify your agreement to the modified Agreements and all of the changes, which will be effective immediately unless we notify you of a later effective date. If the changes are not acceptable to you, you should discontinue use of the Services.

Refund and Cancellation Policy: Non-Degree Programs

Individual Enrollments

All individual course registrations can be cancelled and fully refunded up to 7 days past the course start date or when the course materials have been accessed by a learner. If you are a participant enrolled in a program sponsored by your employer or organization, please contact your employer to discuss cancellation and/or a refund. Corporate partners seeking to cancel or change a scheduled program should reference their individual training agreements.

Requesting a Refund

To request a refund, learners must submit a written refund request via email to workforce@wit.edu. The request should include the learner’s full name, contact information, course name, and enrollment date. WIT will process the refund within 7 days of the receipt of the refund request. Refunds will be issued to the original payment method used during enrollment.

Wentworth Cancellation

Wentworth reserves the right to cancel any course with two (2) business days’ notice. Registrants may opt to enroll in the next available offering of the course or cancel your registration for a 100% refund.

Custom Corporate Training Agreements

If you are a participant enrolled in a program through your employer or sponsoring organization, please contact your employer to discuss cancellation and/or a refund. Corporate partners seeking to cancel or change a scheduled program should reference their individual training agreements.

Textbooks and Course Materials

All textbooks and course materials purchased through the Wentworth Bookstore can be returned, refunded, and/or exchanged in accordance with the WIT Bookstore Online Return Policy.

Academic Credit Non-Eligibility

Courses purchased and accessed through the Wentworth.Pro platform are not eligible for academic degree credit. Upon completion of courses, learners earn Continuing Education Units (CEUs) and a WIT verified digital credential/certificate of completion to showcase on their resume and online channels. A CEU is not an academic credit; however, it is a nationally recognized standard of documenting the successful completion of non-degree professional training. One CEU is equivalent to ten instructional hours.

Learner Ownership & Responsibility: Digital Certificates and Badges

Upon completion of the course, the Learner shall be responsible for their own storage and distribution of digital credentials issued. Access to course materials and the Brightspace Learning Management Software (LMS) shall remain available for up to 180 days from the course purchase date, unless specified otherwise. Learner is required to download or securely store WIT issued credentials using the digital badge and certificate manager made accessible during the learning period. After the stipulated access period, the University shall not be held responsible for the storage or retrieval of these digital credentials.

Course & Materials Access Period

Access to course materials and the Brightspace Learning Management Software (LMS) shall remain available for up to 180 days from the course purchase date, unless specified otherwise.

Wentworth Institute of Technology Policies

Wentworth Institute of Technology (WIT) adheres to numerous state, federal, and university policies to create a fair and equitable educational experience for all, promoting academic integrity, personal responsibility, and positive interaction for learners, faculty, staff, and all university stakeholders. Information Technology Resource Acceptable Use

WIT makes available information technology resources (“ITRs”) to authorized faculty, staff, students, and other University community members for teaching, learning, research, administration and approved purposes. ITRs must be 1.) used in a manner that is consistent with university policies, standards, and applicable law and 2.) respectful of the rights of the Institution and the members of its community. Wentworth only grants use, which shall be limited and conditional, of ITRs to appropriately authorized individuals who agree to the terms and conditions of this Acceptable Use Policy (AUP). Copyright Compliance

WIT expects all members of its community to comply with U.S. copyright laws, and refers all users of its technological and information resources to the Information Technology Acceptable Use Policy and the description of copyright law included therein that governs the use of these resources. The use of WIT information resources including but not limited to networks, emails, and web publishing is a privilege granted by WIT to members of its community or related parties. It is not a right, and the privilege is contingent upon compliance with Institute policies. Pursuant to Institute policy, users of these resources who violate copyright laws may be subject to disciplinary action, including but not limited to loss of access to Institute computers, computer networks, data, and other technological and information resources, warning, suspension and separation from the Institute. Intellectual Property

WIT provides an Intellectual Property Policy (the “IP Policy”) to: (a) encourage the creation, invention, discovery, development, and management of Intellectual Property among its faculty, students, staff, and contractors; (b) address ownership issues related to Intellectual Property developed by, at, or on behalf of WIT; and (c) ensure that benefits derived from Intellectual Property are equitably distributed. The Family Educational Rights and Privacy Act (FERPA)

It is WIT policy to limit the dissemination of student information. The Family Educational Rights and Privacy Act (FERPA) affords students certain rights with respect to their education records. View Annual Notification of Rights.

Non-Discrimination

WIT values diversity, equity, and inclusion. The University is committed to providing a safe and respectful educational experience and work environment free from discrimination and harassment on the basis of an individual’s race, color, religion, age, marital status, national origin, ancestry, disability, sex, sexual orientation, gender, gender identity or expression, genetic information or any other characteristic protected by law. Students, faculty, and staff are expected to adhere to a standard of conduct that is respectful of the rights of the WIT Community. View Policy.

Preferred/Chosen Name, Personal Pronouns, and Formalized Expression of Gender Identity

WIT recognizes the right of students, alumni, faculty, staff, and third parties to use a preferred/chosen name and to use personal pronouns that accurately reflect their gender identity. Pursuant to this policy, any individual may identify themselves using a preferred/chosen name in lieu of or in addition to their legal name.  Preferred/chosen names will be used where possible in the course of WIT programs or activities, where allowed by law. A legal name will be used only when it is required for business, legal, and external reporting purposes. Students, faculty, staff, and all other participants in Wentworth programs and activities are expected to communicate in a way that is considerate of the personal pronouns and preferred/chosen name of others. Intentional non-compliance with this policy may implicate the University’s Non-Discrimination Policy and/or the Sexual Misconduct & Sex-based Discrimination Policy. View Policy.

Sexual Misconduct & Sex-based Discrimination

WIT is committed to maintaining a safe and inclusive living, learning, and working environments for all members of the community. All members of WIT are responsible for maintaining an environment free from sexual discrimination and harassment and are expected to commit themselves to be examples of the highest standards of personal and professional conduct. As provided for in Title IX of the Higher Education Amendments of 1972, WIT prohibits discrimination and discriminatory harassment in all its educational and employment programs and activities on the basis of any individual’s sex, including admission and employment. Additionally, this policy complies with the regulations provided for in the Violence Against Women Reauthorization Act of 2013 (“VAWA”), the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (“Clery Act”), and Title VII of the Civil Rights Act of 1964. Whistleblower Policy

WIT is committed to proper accounting and financial conduct, and compliance with all applicable laws, statutes and regulations. All officers, faculty, staff, employees, consultants, students and parents of the Institute should feel safe to report without fear of reprisal any concerns that are reasonable and made in good faith relating to WIT’s accounting and/or financial conduct, and/or violations of law, statutes or regulations. It is a violation of this policy for anyone, acting on behalf of the Institute, to retaliate against an individual who in good faith reports a possible violation of this policy. Choice of Law; Dispute Resolution

You agree that the Agreements and any claim or dispute arising out of or relating to the Agreements, any Program or other Service, or any content obtained from or through any of the Services will be governed by the laws of the Commonwealth of Massachusetts, excluding its conflicts of law principles. You agree that all such claims and disputes will be heard and resolved exclusively in the federal or state courts located in and serving Middlesex or Suffolk County, Massachusetts, U.S.A. You consent to the personal jurisdiction of those courts over you for this purpose, and you waive and agree not to assert any objection to such proceedings in those courts (including any defense or objection of lack of proper jurisdiction or venue or inconvenience of forum).

Warranty Disclaimer; Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL PROGRAMS AND SERVICES (AS DEFINED AT THE OUTSET OF THESE TERMS OF USE) AND ANY RELATED INFORMATION OR PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND (EXPRESS, IMPLIED OR OTHERWISE), INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WENTWORTH INSTITUTE OF TECHNOLOGY DOES NOT WARRANT THAT ANY SERVICE WILL OPERATE IN AN UNINTERRUPTED OR ERROR-FREE MANNER OR THAT THE ANY SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WITHOUT LIMITING THE FOREGOING, WENTWORTH INSTITUTE OF TECHNOLOGY DOES NOT WARRANT THAT (A) THE PROGRAMS OR SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS OR ACHIEVE THE INTENDED PURPOSES, (B) THE PROGRAMS OR SERVICES WILL NOT EXPERIENCE OUTAGES OR OTHERWISE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, (C) THE PROGRAMS, SERVICES OR INFORMATION OBTAINED THROUGH OR FROM THE PROGRAMS OR SERVICES WILL BE ACCURATE, COMPLETE, CURRENT, ERROR-FREE, SECURE OR RELIABLE, OR (D) ANY DEFECTS IN OR ON THE PROGRAMS OR SERVICES WILL BE CORRECTED. WENTWORTH INSTITUTE OF TECHNOLOGY MAKES NO REPRESENTATION REGARDING YOUR ABILITY TO TRANSMIT AND RECEIVE INFORMATION FROM OR THROUGH THE SERVICES, AND YOU AGREE AND ACKNOWLEDGE THAT YOUR ABILITY TO ACCESS THE PROGRAMS AND SERVICES MAY BE IMPAIRED.

EXCEPT INSOFAR AS THE FOLLOWING LIMITATION MAY BE PROHIBITED BY APPLICABLE LAW, WENTWORTH INSTITUTE OF TECHNOLOGY SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INDIRECT, PUNITIVE, SPECIAL OR INCIDENTAL DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE (INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS OR EARNING POWER, LOSS OF DATA, LOSSES DUE TO ERRORS OR INTERRUPTION IN AVAILABILITY OF ANY SERVICES, UNAVAILABILITY OF ANY PROGRAM, SERVER OR COMMUNICATIONS FACILITY, OR DAMAGES DUE TO ACTS OR OMISSIONS OF OTHERS USING ANY SERVICE OR PARTICIPATING IN A PROGRAM), ARISING OUT OF OR RELATING TO THE AGREEMENTS, THE SERVICES OR THE PROGRAMS, INCLUDING WITHOUT LIMITATION YOUR AND OTHERS' USE OF OR INABILITY TO USE ANY SERVICE, OR YOUR PARTICIPATION IN ANY PROGRAM, OR YOUR SUBMISSION OR USE OF USER CONTENT, OR OTHERS’ USE OF YOUR USER CONTENT, OR YOUR INTERACTION WITH OTHER PROGRAM PARTICIPANTS (WHETHER OR IN PERSON), OR YOUR RELIANCE UPON INFORMATION OBTAINED FROM OR THROUGH ANY PROGRAM OR SERVICE, WHETHER BASED IN CONTRACT, TORT, STATUTORY OR OTHER LAW. WENTWORTH INSTITUTE OF TECHNOLOGY'S TOTAL CUMULATIVE LIABILITY TO YOU ARISING OUT OF OR RELATED TO THE AGREEMENTS, THE SERVICES OR THE PROGRAMS (INCLUDING, WITHOUT LIMITATION, IN THE WAYS DESCRIBED IN THE PRECEDING SENTENCE), WHETHER BASED IN CONTRACT, TORT, STATUTORY OR OTHER LAW, WILL NOT EXCEED THE GREATER OF (1) THE TOTAL AMOUNT OF FEES RECEIVED BY WENTWORTH INSTITUTE OF TECHNOLOGY FROM YOU OR ON YOUR BEHALF FOR OR IN CONNECTION WITH THE SERVICES AND ANY PROGRAMS IN ANY TWELVE MONTH PERIOD OR (2) U.S.$100. THE DISCLAIMERS AND LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHETHER OR NOT WENTWORTH INSTITUTE OF TECHNOLOGY HAS BEEN NEGLIGENT OR OTHERWISE AT FAULT.

YOU ACKNOWLEDGE AND AGREE THAT THE WARRANTY DISCLAIMERS AND THE LIMITATIONS OF LIABILITY SET FORTH IN THESE TERMS OF USE REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND WENTWORTH INSTITUTE OF TECHNOLOGY, AND THAT THESE LIMITATIONS ARE ESSENTIAL TO WENTWORTH INSTITUTE OF TECHNOLOGY'S WILLINGNESS TO MAKE THE SERVICE AND PROGRAMS AVAILABLE TO YOU. EACH OF THESE DISCLAIMERS AND LIMITATIONS IS INTENDED TO BE SEPARATELY ENFORCEABLE, REGARDLESS OF WHETHER ANY OTHER REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

FOR PURPOSES OF THE FOREGOING DISCLAIMERS AND LIMITATIONS, AS WELL AS THE INDEMNITY IN SECTION 14 BELOW, “WENTWORTH INSTITUTE OF TECHNOLOGY” INCLUDES WENTWORTH INSTITUTE OF TECHNOLGY, INC.  ITS TRUSTEES, ITS OFFICERS, FACULTY MEMBERS, EMPLOYEES, AGENTS, CONTRACTORS, AND REPRESENTATIVES.

CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THE LAWS OR REGULATIONS OF THESE JURISDICTIONS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

Indemnification

You agree to indemnify and hold harmless WENTWORTH INSTITUTE OF TECHNOLOGY from any and all claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees and costs, relating to or arising out of (a) your use or attempted use of any of the Programs or other Services in violation of the Agreements; (b) your violation of any law or rights of any third party; or (c) information or content that you post or otherwise make available through any Program or otherwise via any of the Services, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.

This policy discloses the privacy practices for wit.edu and for subdomains of wit.edu, and for content using other third-party vendors whose services Wentworth Institute of Technology (the university) may be using. This policy sets out how Wentworth Institute of Technology uses and protects any information that you give Wentworth Institute of Technology when you use wit.edu, a wit.edu subdomain, as well as other information you may provide to us directly.
